Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of GrowthGlass (the "Service"), operated by Lextronica, Inc ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

GrowthGlass tracks and analyzes how brands appear across the web, social platforms, and AI assistants, and provides related analytics, alerts, reporting, and API access. We may add, change, or remove features over time.

3. Accounts

You are responsible for safeguarding your account credentials and for all activity under your account. You must provide accurate information and promptly update it. You must be at least 18 years old to use the Service.

4. Trials, plans & billing

• Free trial. New workspaces start a 7-day free trial. No payment is required to begin the trial.
• Subscriptions. Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor (Stripe) until cancelled.
• Credits. Optional prepaid AI credits are sold in one-time packs, are consumed by managed AI usage, and are non-refundable except where required by law. Credits do not expire.
• Auto-renewal. Subscriptions renew automatically. You can cancel at any time from billing settings; cancellation takes effect at the end of the current billing period.
• Refunds. Except where required by law, fees are non-refundable. [Describe your refund policy here.]
• Taxes. Fees are exclusive of taxes, which you are responsible for where applicable.

5. Acceptable use

You agree not to misuse the Service. In particular, you will not:

• Break the law or infringe others' rights, including intellectual property and privacy rights.
• Attempt to gain unauthorized access to the Service or its systems, or probe, scan, or disrupt them.
• Resell or provide the Service to third parties except as expressly permitted by your plan.
• Use the Service to send spam, harass, or generate unlawful, deceptive, or harmful content.
• Exceed documented rate limits or circumvent usage metering.

6. Your data & AI processing

You retain ownership of the brands, prompts, and other content you submit ("Customer Data"). You grant us a limited license to process Customer Data to provide and improve the Service.

To generate AI visibility results and analyst responses, we send certain inputs (such as prompts) to third-party AI providers acting as our subprocessors. See our Privacy Policy for details, and our Security page for how we protect data.

7. Intellectual property

The Service, including its software, design, and content (excluding Customer Data), is owned by us and our licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service per your plan.

8. Third-party services

The Service relies on third parties (for example AI providers, payment processing, and data sources). We are not responsible for third-party services and their use may be subject to their own terms.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. AI-generated outputs may be inaccurate or incomplete; you are responsible for evaluating them before relying on them. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim arising out of these Terms or the Service will not exceed the amounts you paid us in the 12 months before the claim.

11. Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you breach these Terms or to comply with law. Upon termination, your right to use the Service ends; we may delete Customer Data after a reasonable period.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (for example by email or in-app). Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. The state and federal courts located in California, USA will have exclusive jurisdiction.
